중앙정부가 지방자치단체의 기구규모와 정원을 총량적으로 규제하고, 경우에 따라서 지방자치단체의 조직개편에 내용적으로 간여하는 가장 중요한 이유는 지방자치단체의 자치조직권 남용에 대한 우려이다. 그리고 이러한 중앙정부의 우려에는 나름의 타당성이 존재한다. 시간이 흐름에 따라 한시적으로 만들어진 조직이 영구조직이 되고, 별정직으로 충원된 공무원이 손쉽게 일반직이 되고, 기능이 없어지거나 쇠퇴한 조직이 사라지지 않는 등의 일이 한국의 지방자치단체에서 어렵지 않게 발견되기 때문이다. 그럼에도 불구하고 지방자치단체에서 발견될 수 있는 이러한 병리현상이 현재와 같은 조직 및 인력에 대한 규제를 충분히 정당화할 수 있는 지 그리고 현재수준의 규제가 앞으로 과연 얼마나 지속되어야 할 지의 여부에 대해서는 깊은 성찰이 필요하다.
