살인용의자들이 세속의 사법권이 미치지 못하는 교회나 수도원과 같은 성역으로 도피하는 것은 자신이 범인이 아니라는 항변의 표시이기도 하지만, 한편으로는 범죄용의자를 체포하지 못하는 성역권을 이용하기 위해서이다. 그렇다고 살인용의자의 도피를 수수방관하지는 않았다. 법에 따라 궐석재판을 하는 것이 상례이다. 그리고 후에 살인용의자가 체포되면 재판결과를 그대로 집행하였다. 그러나 교회 내에서 일어난 살인사건에 대한 처리는 이와 달랐다. 예컨대 교회 서기를 살해한 자가 교회관리인에게 체포되어 순회재판관들에게 인계됨으로써 교수형에 처해졌다. 이와 같이 교회구성원들이 범인을 체포하여 주 장관에게 인계함으로써 성역권을 침해하지 않는 가운데 범죄용의자를 체포할 수 있었다. 만약 범죄용의자의 무죄 주장이 배심원들에게 받아들여지지 않으면, 그의 재산은 국왕에게 몰수되고 교수형에 처해졌다. 범죄용의자에 대한 국왕의 동산몰수는 외견상 당시 보통법의 정신과 배치되는 처벌이다. 즉 보통법에서는 범법자가 유죄판결을 받기 전에는 그의 동산이 약탈되거나 토지소유권을 몰수하지 못한다고 언급하고 있다. 그러나 중죄혐의자가 재판을 받지 않고 도피하면 유죄로 인정되었기 때문에 실제로는 재산몰수란 재판을 기피하고 도피한 자에 대한 벌칙이어서 유죄판결과는 상관없이 도피자의 재산을 몰수하는 것이 일반화되었다. 1307년에서부터 1350년까지의 페이텐트 롤즈의 기록으로부터 958건의 법익권 박탈에 관한 사실을 확인할 수 있었다. 이에 따르면 범법행위를 저지른 후 도피한 자들이 반드시 중죄인들만은 아니었다. 예컨대 단순 절도행위자도 도피하여 법익권을 박탈당하는 경우가 기록에 자주 등장한다. 그러므로 법익권 박탈이란 메이트랜드(Maitland)의 주장과는 달리 어떠한 형태의 범죄라도 범행 후 적절한 사법적 절차를 받지 않고 도피한 자들 모두에게 적용된 제재방법이었다. 물론 사면령에 따라서 박탈당하였던 법익권을 다시 회복하게 되고 몰수당한 동산도 되돌려 받은 경우도 있다.
