II. ‘법의 지배’의 의의와 본질
1. ‘법의 지배’: 개념과 의의
우리의 ‘법의 지배’에 관한 인식은 지극히 혼란하다. 이 문제에 관해 Hayek(1960, 1973, 1976, 1979)만큼 체계적으로 잘 정리하고 있는 학자는 아마 없을 것이다. 그는 법학자, 정치학자, 경제학자로서 사회의 근본문제인 인간의 지식과 인식능력의 한계 문제로부터 출발하여, 무지한 인간이 의미있게 상호작용하고 협력해 자유로운 사회, 풍요한 사회를 건설해 나가기 위해서는 우리가 어떻게 법을 이해하고, 어떤 오류에서 벗어나야만 할 것인가라는 관점에서 ‘법의 지배’의 문제를 보고 있다.
그에 따르면, ‘법의 지배’는 “모든 입법에 대한 제한”(a limitation upon all legislation)이다(1960: 205). 어떤 하나의 법이 합법적(legal)으로 제정되고 집행되어 그 법이 의도한 효과를 발생시키고 있다고 해서 ‘법의 지배’가 이루어지고 있다고 말한다면 그것은 ‘법의 지배’의 개념을 올바로 사용하는 것이 아니다. ‘법의 지배’는 특정한 ‘법의 지배’를 말하는 게 아니라, 일반적으로 법이 어떠해야 하는가에 대한 법칙, 즉 상위법적 원리(meta-legal doctrine) 또는 정치적 이상이다(p. 206). 법이 어떠해야 하는지에 관한 원리, 그리고 특정의 목적을 가진 법들이 갖추어야 할 일반적 속성에 대한 원리가 ‘법의 지배’다. 오늘날 이 구분은 매우 중요하다. 법이 법으로서 지켜져야 한다는 단순한 합법성(legality)이 ‘법의 지배’인 양 오인하는 일이 너무 빈번해서다(p. 205).
