II. 책임개념의 사상적 컨텍스트
자신의 이익만을 추구하는 신고전경제주의의 인간상은 권력에 대한 근본적인 의심에 기초한 제도의 필요성을 각인시켰다. 경제적 활동에 있어 인간의 이기심은 소위 “보이지 않는 손”에 의해 궁극적으로 전체의 이익에 기여할 수 있는 것으로 여겨졌지만, 정치-사회적 측면에서는 동일한 처방을 통해 독재나 무질서라는 극단적인 폐해를 피할 수는 없었던 것이다. 따라서 권력에 대한 근본적인 회의와 경계(Vigilance)는 분명히 정치적 제도의 성공에 필수적이었지만, 그것만으로는 부족했다. 동료 인간에 대한 경계는 독재를 피하게 해줄 수 있었을지언정, 무질서에서 탈피할 길을 제시하지는 못했던 것이다.
따라서 미국 헌법의 사상적 배경에서 권력에 대한 근본적인 의심 또는 경계와 더불어 쌍벽을 이루는 요소가 있다면 바로 합리적인 권력이 가능하다는 믿음이었다. 언뜻 보기에는 이 두 가지가 과연 공존할 수 있을 것인지에 대해 의구심이 들 수 있지만, “모든 인간을 일단 악한으로 보는 것” David Hume, Essays, Moral, Political and Literary (Indinanapolis: Liberty Press, 1985), p. 42
