. 주권에 관한 한 동등한 논리가 국가와 개인에게 적용된다. “각 주권국가가 자신의 영토를 지배하며 다른 어떤 국가도 이를 침범할 수 없는 것과 같이, 주권적 개인도 다른 어떤 사람이 침범할 수 없는 자신의 삶과 행위를 영위한다. 그 행동이 남을 해치지 않는다면.” (Chan, 1999:231) 아무리 사소한 것일지라도 개인은 자신의 영역 내에 있는 어떠한 것에 대해서도 절대적 통제권을 가지고 있다는 점에서 개인주권은 국가주권과 동등한 효력을 지닌다 (Feinberg, 1986:55). 이러한 이유에서 개인은 포르노물도 볼 권리가 있다. 어떤 국가권력도 이런 개인의 자유를 통제하는데 합법적으로 사용될 수는 없다.
유교주의자들은 개인중심적인 인권개념의 사회적 결과를 깊이 걱정하기 때문에 자유주의자들의 개인주권과 독립성의 발상을 받아들일 수 없을 것이다. 그들은 인권 그 자체를 반대하는 것은 아니나, 과도한 개인주의적 견해와 생활 양식들이 남을 해하지는 않을지라도 도덕적으로 부패하거나 저급한 것일 경우에는 사회적 통제가 필요하다라고 주장한다 (Chan, 1999:230). 따라서 이들의 입장에서는 인권이라는 것도 도덕적 윤리적으로 선한 삶을 고양시키…(생략)
