2. 멕시코 노사정 관계의 기본구조
1) 법령
권위주의 국가에서는 대부분 그렇지만, 멕시코에 있어서는 특히 노동법이 노사관계를 규정하는 중요한 통제장치이다. 멕시코의 노동법은 1911년 혁명이후 자연발생적으로 생겨난 여러 법들의 기본정신이 1917년에 제정된 헌법 제123조로 모아졌다가, 1931년 연방노동법이 제정되면서 그 구체적인 내용들을 가지게 된 것이다. 제한된 지면관계상 멕시코 연방노동법의 구체적인 내용이나 그 변천의 역사에 대해서 길게 논할 여유는 없기 때문에, 여기에서는 그 특징과 그것이 멕시코의 노사정관계에 미친 영향을 간단히 고찰해보는 것으로 그치기로 한다. 멕시코 노동법의 역사와 그 구체적인 내용에 대해서는 Franco(1991)를 참조.
멕시코 노동법의 특징적인 점과 그것이 노사정관계에 미친 영향을 열거하면 다음과 같다.
첫째, 이 법은 노동조합에 대한 인정권을 국가에 부여하고 있다. 따라서 국가는 비협조적이거나 그럴 가능성이 있는 노동조합의 설립을 허용하지 않거나 등록을 취소하는 것을 통해서 공식노조를 육성하고, 자주노조의 설립과 그 정상적인 운영을 방해해왔다. 또한 법률에 명기된 것은 아니지만 국가가 노동조합의 등록여부를 판정하는데 있어서 관행적으로 기준으로 삼아온 ‘1 기업 1 노조주의’도 공식노조의 지배권을 강화하는데 일조해왔다.
둘째, 이 법은 파업의 합법성에 대한 판정권을 국가(보다 정확하게는 알선조정위원회)에 부여하고 있다. 위원회는 파업의 목적, 주체, 대상, 절차 등을 심의하여 파업의 합법, 불법, 그리고 무효(nonexistent)를 선언할 수 있다. 이 위원회는 노사정 3자동수로 구성되는데, 노동자측 대표는 흔히 공식노조이다. 따라서 파업의 주체가 국가와 동맹관계에 있는 공식노조나 그 산하의 조직일 경우에는 노동조합측에 유리한 판정이 날 가능성이 많으며, 반대로 파업의 주체가 공식노조에 반기를 든 자주노조일 경우에는 불법의 판정이나 ‘무효’ 판정이 내려질 가능성이 압도적으로 높아진다.
