정의를 실현하는 정규적인 정부를 향유하지 못하고 있는 국가에서는 상업과 공업이 번성하기가 극히 어렵다. 정의롭지 못한 정부하에서 사람들은 자신의 재산소유의 안전을 느끼지 못하고, 계약에 대한 신뢰가 법에 의해서 보장받지 못한다.
이러한 사유재산권과 계약의 자유를 법적, 제도적으로 가장 잘 보호해줄 수 있는 정치체제가 민주주의이다. 물론 권위주의 국가도 재산권을 보호하고 계약을 보장해 줄 수 있다. 그러나 강력한 권위주의 국가는 시민들의 재산을 약탈하는데도 충분히 강력할 수 있는 것이다. 민주주의의 장점은 경제적 자유를 `법의 지배`를 통해 보호해준다는 데 있다. 민주주의가 제공하는 법의 지배, 언론의 자유, 계약의 자유, 이동의 자유, 조세에 관한 사회적 합의 없이 시장이 필요로하는 사유재산권과 기업가 정신, 혁신의 꽃을 피울 수 없다는 것이다.
둘째로, 자본주의 시장경제는 소비자주권이 작동하는 민주주의이다. 자본주의 시장경제하에서 기업가가 이윤을 극대화하기 위해서는 소비자가 가장 선호하는 상품을 제공하여야한다. 결국 소비자의 선호가 생산과 분배과정을 지배하게된다. 반면에 경쟁시장적 정치체제인 민주주의하에서는 인민주권이 작동한다. 민주주의하에서 정치권력을 장악하려는 정치인은 투표로 계산되는 인민의 지지를 극대화해야하고, 인민의 지지를 극대화하기 위해서는 인민이 집단적으로 가장 선호하는 정책을 제공해야한다. 결국 민주주의하에서 인민의 선호가 정치과정을 지배하게된다. 따라서 시장경제와 민주주의는 생산자와 소비자, …
