헌법이나 정당법에는 물론 정당이 민주적으로 운영되어야 한다고 규정되어 있다. 공직 후보자 추천의 예를 들면 정당법은 당의 대의기관의 의사를 반영하여 민주적으로 하여야 하고 구체적 절차는 당헌으로 정한다고 하고 있다. 그렇다면 여기서 정해진 대원칙대로 공직 후보자 추천이 민주적으로 이루어지고 있다고 할 수 있는가? 이에 대한 대답은 망설일 것없이 부정적이다. 1995년 지방선거 시에 몇몇 도지사 선거에서 대의원 대회를 통한 경선을 벌인 것을 제외하면 형식적으로나마 민주적 절차로써 공천하는 경우가 거의 없었다. 국회의원 총선이 다가오면 다소 공개적으로 공천을 한다고 여야할 것없이 신청을 받고 당의 고위간부들로 공천심사위원회를 구성하며 도덕성이니 당선가능성이니 하면서 공천기준도 제시한다. 그런데 결과를 보면 당의 최고 지도자와 최측근에서 결정이 내려진다. 수뇌부가 뜻을 두고 영입한다는 외부인사도 상당수 공천되기 마련인데 실제 공천 기준은 수뇌부와의 친소관계, 연고관계, 아니면 심지어 금품거래 등에 좌우되는 경우가 많다.
공직자 후보에 대한 결정뿐만 아니라 중요 사안에 대한 의사결정이 모두 비민주적이다. 중앙위원회와 중앙상무위원회와 같은 정책결정기구를 만들어 놓았지만 그 기능은 수뇌부의 의사를 뒷받침해주는 통과의례를 행하는 것이다. 중앙당 말고 시·도지부와 지구당을 어지럽게 구성해 놓고는 이들은 평상시에 해당 지역의 관혼상제 연락업무나 하도록 하고 선거 때는 이미 정해진 후보의 당선을 위해서 가동된다. 당의 정책을 수립하고 선거전략을 세우고 재정을 확보하는 과정에서 일반당원들의 책임과 역할이란 전무하다. 정당의 주요 의사결정은 최고 지도자와 그의 측근에 의하여 밀실에서 행해진다.
