미국 장애인 교육법과 그 법령에는 능력본위 교육과정이나 교사의 전문능력에 관한 언급이 없고 특수교육 교사의 전문능력을 구성하고 있는 지식과 기술에 관하여는 구체적으로 규정하고 있다. 1997년 장애인 교육 개정법 601조 (c)(5)(E)항에는 교사들이 가능한 한 발달적 목적과 모든 장애 아동을 위하여 정해진 도전적인 기대를 충족시키고 생산적이고 독립적인 성인 생활로 이행하도록 하는데 필요한 ‘지식과 기술’을 갖추도록 함으로써 장애 아동을 지도하는 모든 전문가의 질 높은 인력개발을 지원한다고 규정하고 있다. 또한 673조에 교육부 장관은 전문가들이 연구와 경험을 통하여 성공적임이 입증되고 장애 아동을 지도하는데 필요한 ‘지식과 기술’을 갖추도록 한다고 규정하고 있다. 601조 (J)(e)(2)(A)(ii)항에는 교사를 양성하는데 가장 좋은 실제 방법과 연구에 기초를 둔 지식을 통하여 교사들이 장애 아동의 교육적 결과를 개선하는데 필요한 ‘지식과 기술’을 갖추도록 한다고 되어 있다.
