한국은 오랫동안 억압적 노동의 전형적 국가였으며, 권위주의적 억압에서 벗어나 민주적 노사관계를 성취하기 위해 다면적 갈등을 겪고 있는 중이다. 십 년 남짓한 민주화 기간 동안 노사관계는 괄목할만한 발전을 이룩하였지만, 그것이 민주적 노사관계라고 하기에는 미진한 점이 여전히 많으며, 노사정간 합의에 기초한 노사관계 모델도 아직 모습을 드러내지 않은 상태이다. 한국은 이런 의미에서 이중적 과제에 직면하고 있다. 아직도 그 구체적 내용과 제도를 둘러싸고 이견이 분분한 ‘민주적 노사관계’를 아무튼 이룩해야 한다는 오랜 과제가 하나이고, 세계화의 거센 조류와 노사관계의 환경변화에 따라 노사관계 개혁의 방향과 정책 자체를 바꾸어야 한다는 시대적 압력이 다른 하나이다.
두 개의 요구와 과제는 서로 연결된 듯이 보이지만, 그 가치와 실현방식에 있어 사실상 상충적인 요인들이 잠재해있다. 전자는 시장개입과 제도 수정을 통하여 노동권을 확보하고 조직노동의 단체교섭력을 증진하려는 것을 겨냥하는 반면, 후자는 세계시장과 생산기술의 변화를 적극적으로 수용하여 생산성과 효율성을 극대화하는 것에 초점을 두고 있기 때문이다. 양자…(생략)
